Terms of Use

1. Who may use ProPocket

You must be at least 18 years old (or the age of majority in your place of residence) and able to form a binding contract. The Service is for business quoting, not personal consumer use by children. If you use ProPocket for a company, you represent that you have authority to bind that company.

2. The Service

ProPocket helps you capture clients, build on-site quotes (photos, notes, line items), share text or PDFs, and track draft, sent, and approved jobs. Free and Pro limits and features are described in the app and on the site (currently Free: up to 15 clients, 25 quotes, 8 templates; Pro: up to 500 clients, 500 quotes, 40 templates, plus branded PDFs, AI polish, and follow-up reminders). We may change features or limits with notice where required. This website does not sell subscriptions. Checkout is only in the iOS or Android app.

The Service is a tool. It is not legal, tax, or professional advice. Quotes you send are your business communications. You are responsible for pricing, scope, licenses, insurance, and your relationship with clients.

3. Accounts

Keep your login details confidential. You are responsible for activity under your account. Provide a working email and complete verification. Tell us at support@propocket.app if you think someone else used your account. We may refuse, suspend, or close accounts that violate these Terms or that we reasonably believe are a security risk.

4. Your content and client data

You retain ownership of content you submit (clients, quotes, photos, notes, templates, logos, and similar). You grant us a worldwide, non-exclusive license to host, store, sync, back up, process, and display that content only as needed to operate the Service, including Pro features you use.

You represent that you have all rights and consents needed to upload and share that content, including personal information about your clients. Do not upload content that infringes others’ rights or that you are not allowed to store. You are the controller of your client records. We process them to provide the Service.

Sharing a quote (text or PDF) or sending a follow-up is your action. Recipients see what you send. We are not a party to your contracts with clients.

5. Photos, notes, and AI polish

Photos and notes may be stored on your device and our servers. You must have permission to photograph jobs and to include people or property in those photos.

Pro AI polish may send note text to a processor to return a revised draft. Results can be incomplete or incorrect. You must review and edit before sending a quote. Do not rely on polish as a substitute for your own description of the work.

6. Offline use and devices

Drafts may cache on your device and sync when a connection is available. We do not warrant that every draft will sync in every network condition. If a device is lost, reset, or damaged before sync, unsynced data may be lost. Keep the app updated and protect the device.

7. Subscriptions, auto-renewal, and cancellation

Pro is an auto-renewing in-app subscription sold by Apple or Google, with entitlements managed via RevenueCat. Price, duration, and trial (if any) are shown in the app purchase sheet before you confirm. Payment is charged to your Apple ID or Google account. The subscription renews unless you cancel at least 24 hours before the end of the current period (or as required by the store). After purchase, manage or cancel in your Apple or Google account settings, not on this website. Unused portions of a period are generally not refundable except as required by the store or by law. Refund requests are handled by Apple or Google under their rules. Taxes may apply.

If you delete your ProPocket account, that does not automatically cancel a store subscription. Cancel the subscription in Apple or Google settings as well.

8. Acceptable use

You agree not to:

• Break the law or use the Service to harass, defraud, or harm others.
• Probe, scan, or bypass security, or access another user’s account.
• Reverse engineer, scrape, or resell the Service except as allowed by law.
• Upload malware or interfere with servers, sync, or other users.
• Use the Service to send spam or unlawful marketing to clients.
• Misrepresent your identity or your authority to quote for a business.

9. Our intellectual property

The app, website, name, logo, and software are owned by ProPocket or its licensors. We grant you a limited, revocable, non-transferable license to use the app on devices you own or control, and to use this website, solely for your internal business quoting as intended. Store badges and trademarks of Apple and Google belong to them.

10. Third-party services

Sign-in, hosting, maps directions, sharing sheets, Apple, Google, and RevenueCat are third-party services with their own terms. We are not responsible for those services when they fail or change. If you download from the App Store or Google Play, those store terms also apply. In a conflict about payment, the store’s terms for the purchase control.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that quotes, PDFs, sync, offline cache, reminders, or AI polish will be accurate, uninterrupted, or error-free, or that lost data will be recoverable.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ProPocket AND ITS OPERATORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR LOST-PROFIT DAMAGES, OR FOR LOST DATA, LOST JOBS, OR CLIENT DISPUTES, EVEN IF WE WERE ADVISED THEY WERE POSSIBLE.

OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID FOR PRO IN THE 12 MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US$50).

Some places do not allow certain limits. In those places, our liability is limited to the maximum extent allowed. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence where such a limit is forbidden.

13. Indemnity

You will defend and indemnify ProPocket and its operators against claims, damages, and reasonable legal fees arising from your content, your quotes or client relationships, your violation of these Terms, or your violation of law or third-party rights, except to the extent caused by our willful misconduct.

14. Suspension, termination, and deletion

You may stop using the Service and delete your account in app settings at any time. Deleting the app is not the same as deleting the account. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service. We will try to give reasonable notice if we shut the Service down, except where we cannot. After termination, sections that should survive (including 4, 9, 11, 12, 13, and 16) remain in effect.

15. Changes to these Terms

We may update these Terms. We will change the “Last updated” date and, for material changes, provide notice in the app or by email when appropriate. If you continue to use the Service after the update takes effect, you accept the new Terms. If you do not agree, stop using the Service and delete your account.

16. General

These Terms are the agreement between you and us for the Service. If a provision is unenforceable, the rest remains in effect. We may assign these Terms in connection with a merger, sale, or reorganization. You may not assign them without our consent. Failure to enforce a provision is not a waiver. Headings are for convenience only.

These Terms are governed by the laws applicable to the provision of the Service, excluding conflict-of-law rules, except that mandatory consumer-protection laws of your country of residence still apply where they cannot be waived. Courts of competent jurisdiction may hear disputes, subject to those mandatory protections.
